Housing Element Update

Project Status

On May 9, 2019, the Local Coastal Program amendment associated with the 2008-2014 Housing Element was approved, with suggested modifications, by the California Coastal Commission (CCC) (staff report). On July 8, 2019, the City Council will hold a public hearing to consider an updated LCP amendment that reflects the actions taken by the CCC  to conditionally certify the amendments needed to implement the City’s Housing Element. To view the City Council agenda report, visit the Agenda Center - see Item 4C. Once the City Council adopts the Ordinance to accept the CCC’s suggested modifications, the adopted Ordinance would then be resubmitted to the CCC for final certification of the LCPA.

Next Steps

The City of Malibu, along with all jurisdictions in California, is mandated by California State Government Code Sections 65580 to 65589 to prepare Housing Element updates to its General Plan for State certification within a specified timeframe covering a range of years. The City falls within the Southern California Association of Governments (SCAG) for purposes of this process.  State Housing Element law requires that each City and County identify and analyze existing and projected housing needs within their jurisdictions, and prepare goals, policies, programs and quantified objectives to further the development, improvement, and preservation of housing. SCAG is now in the process of developing the next planning period Regional Housing Needs Assessment (RHNA) which will cover October 2021 through October 2029.  Staff is currently working with the City’s Housing Consultant and SCAG on the RHNA allocation for Malibu.

Background

The State of California Housing Element Law, enacted in 1969, mandates that local governments adequately plan to meet the existing and projected housing needs of the community in all economic levels. Included in this State law is the requirement that local governments adopt land use plans and regulatory systems that provide opportunities for, and do not unduly constrain, housing development. The State also requires that Housing Elements be updated and certified every five years to reflect the most recent trends in demographics and employment that may affect existing and future housing demand and supply.

On August 26, 2013, the City Council adopted the 2008-2014 General Plan Housing Element Update and certified the Environmental Impact Report (EIR). As part of the 2008-2014 Housing Element, various amendments and additions to the Malibu Municipal Code, the City’s LCP Local Implementation Plan, and the Zoning Map, including the adoption of a new Chapter 17.41, Affordable Housing was proposed. The amendments are pending certification by the California Coastal Commission. Subsequently, on September 10, 2013, Department of Housing and Community Development certified the housing element.

On January 13, 2014, the City Council adopted the 2013-2021 Housing Element Update. On February 12, 2014, the Department of Housing and Community Development certified the housing element.

On July 13, 2015, the City Council adopted Ordinance No. 388 an amendment to M.M.C. Section 17.41.010 (Affordable Housing) to amend the provisions of subsection (D)(2)(b) to correct a drafting error in and clarify the intent of Ordinance No. 375 by deleting the words “density bonus and” from this subsection.

Since the 2013, City staff and the California Coastal Commission have been working through the proposed amendments.
