    Insured’s name on the General Liability Insurance must match the name listed on the application.

    Proof of insurance coverage is required from all outside providers including: caterers, rental companies, etc.

    Insurance may be obtained through the City.  Additional fees will apply and may require underwriter approval.

    Alcohol: Additional insurance coverage and staffing fees will apply. Beer and Wine only. No hard alcohol.

    Tents: Additional permits are required for tents larger than 200 square feet.

Applicant hereby agrees to defend and hold the City of Malibu, the Santa Monica-Malibu Unified School District, the State of California, the individual members and all officers, agents, and employees of the City, District and State, free and harmless from any loss, damage, liability, cost or expense that may arise during or be caused in any way by such use or occupancy of City or school property. Applicant agrees to furnish such liability or other insurance for the protection of the public, the City, the District, and the State as may be required. The applicant also agrees to use all equipment they bring onto the premises according to the manufacturers specific recommendations and any issues or damage that arises from the use of said equipment falls under the applicants responsibility and liability.
87. Applicant hereto warrants and represents that he or she is competent and authorized to enter into this Agreement on behalf of the party for whom he or she purports to sign. The City and Applicant agree that this Facility Use Agreement and related documents to be entered into in connection with this Facility Use Agreement will be considered signed when the signature of the Applicant is delivered electronically by clicking the “Submit” button below. Such electronic delivery will be treated in all respects as having the same effect as an original signature.

I the undersigned, hereby certify that I will be personally responsible on behalf of the applicant for any damages sustained by the park building, furniture, equipment, or grounds accruing through the occupancy or use of said building and/or grounds by applicant. I hereby certify that I have read the rules, regulations, conditions, and terms of this application and that I, and the applicant which I represent, will abide by them and will conform to all applicable provisions of the Constitution and laws of California and to all other directives of the City, District and the State and their authorized agents. I further certify that I, and the organization I represent, will comply with all the provisions of the Americans with Disabilities Act during that period of time when authorized to use the buildings/grounds of the City of Malibu, and/ or the Santa Monica-Malibu Unified School District.
