About the Program
On June 24, 2024, City Council amended Malibu Municipal Code Chapters 15.40, 15.42, and 15.44 to require additional onsite wastewater treatment systems (OWTS) requirements for home occupation uses (HOU) that place additional strain on the OWTS. This program is effective as of July 24, 2024.
Requirements
Properties with a home occupation use that increases the quantity and/or strength of flow to the OWTS require the following:
- An advanced OWTS
- An OWTS design report demonstrating the OWTS can accommodate the quantity and/or strength of flow of the proposed home occupation use
- An Operating Permit valid for 2 years
Application Process
- Applicants will request a Residential Planning Clearance Application from the Planning Department during counter hours (Monday to Friday, 8AM – 12PM) to determine if a permit for the home occupation use will be required prior to submitting to Environmental Health.
- The Application will be routed to Environmental Health for review to determine if an advanced OWTS is required.
Enforcement
When the City has received an OWTS complaint for a property with a home occupation use, a City Registered Operation and Maintenance Practitioner is required to inspect the OWTS and provide an inspection report to the City within fifteen (15) days of the City’s receipt of the complaint. The home occupation use will be required to cease operation until all required repairs, modifications, replacements, and/or upgrades have been completed to the satisfaction of the administrative authority.
